Terms and Conditions

CAD:CAM Masterclass Provider: Alexander Schwärzler Email: info@cadcam-masterclass.com

1. Scope

These Terms and Conditions apply to all registrations for continuing education courses ("Courses") offered by CAD:CAM Masterclass. They are directed exclusively at business customers within the meaning of § 1 KSchG (Austrian Consumer Protection Act), in particular dentists, dental technicians, and comparable dental specialists who register in the course of their professional activity.

2. Formation of Contract

By submitting the registration form, the participant makes a binding offer to attend the selected course. The contract is not binding on CAD:CAM Masterclass until a deposit of 50% of the course fee has been received. Prior to receipt of this deposit, CAD:CAM Masterclass is not obligated to reserve a place for the participant and may allocate the place to another registrant.

3. Scope of Services

The scope of the course (content, duration, location, instructor) is set out in the relevant course description on the website or registration form. The organizer reserves the right to make minor program changes for organizational or professional reasons, provided the overall character of the course is not materially affected.

4. Fees and Payment

  • The course fee is set out in the relevant course listing and, unless otherwise stated, is exclusive of applicable statutory VAT.

  • A deposit of 50% of the course fee is due upon registration and renders the booking binding on CAD:CAM Masterclass (see Section 2). The remaining balance is due prior to the start of the course, within the payment period stated on the invoice.

  • In the event of late payment, the organizer is entitled to refuse participation, without this giving rise to any claim for reimbursement of amounts already paid.

5. Cancellation and Withdrawal

5.1 No statutory right of withdrawal for business customers. CAD:CAM Masterclass is offered exclusively to members of the dental profession who book in the course of their professional or business activity. By registering, the participant expressly confirms that the booking is made in a business capacity. As this is not a consumer transaction, the statutory distance-selling right of withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG) does not apply.

5.2 Withdrawal after payment. Once the 50% deposit (or full fee) has been paid, withdrawal from the booking is not possible and the course fee remains payable in full. This applies regardless of whether the remaining balance has yet fallen due.

5.3 Transfer of place. Transferring the booked place to another person from the same practice or organization is possible after prior consultation with the organizer.

5.4 No-show. In the case of a no-show without prior notice, there is no entitlement to a refund or a make-up session.

5.5 Cancellation by the organizer. If the course must be cancelled for reasons attributable to the organizer (e.g. illness of the instructor, insufficient number of participants), any fee already paid will be refunded, or, at the participant's choice, an alternative date will be offered. Further claims — in particular for reimbursement of travel or accommodation costs — are excluded to the extent permitted by law.

5.6 Note on consumers. This section is legally valid only as long as participants register in a business capacity. If, exceptionally, a private individual (a "consumer" within the meaning of the KSchG) registers, that person retains the statutory 14-day right of withdrawal under the FAGG, irrespective of this section.

6. Use of Course Materials and Intellectual Property

All materials, scripts, and digital content provided as part of the course are protected by copyright. Reproduction, distribution to third parties, or public availability, in whole or in part, is not permitted without the organizer's prior written consent. Use is limited to the participant's personal, professional use.

7. Photography and Video Recording Prohibited

Photography, filming, and audio or video recording of the course — in whole or in part, by any means and by any participant — is strictly prohibited, in order to protect the intellectual property of the instructors and the organizer. Any breach of this prohibition entitles the organizer to require immediate deletion of the recording and to exclude the participant from the remainder of the course without refund.

8. Liability

The organizer is liable only for damages caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law. Participants are solely responsible for the professional and legal application of course content in their own practice; the course does not replace individual professional advice.

9. Certificate

A certificate of attendance or participation is issued upon successful completion. Whether the course is recognized for continuing education credits by professional chambers or associations is the responsibility of the relevant institution and is not guaranteed by the organizer.

10. Data Protection

The processing of personal data is governed by the separate Privacy Policy.

11. Governing Law and Jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG). The competent court in Vienna, Austria, shall have exclusive jurisdiction over any disputes arising from or in connection with this contract, to the extent legally permissible.

12. Severability

Should any individual provision of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
